Policy holder sues insurer claimint it failed to cover Hurricane Isaac damage

NEW ORLEANS – An insurance company has been sued for allegedly failing to honor a client’s policy regarding wind damages following Hurricane Isaac.

Chrisna Inc. filed suit against Certain Underwriters at Lloyd’s of London in the Orleans Parish Civil District Court.

The plaintiff asserts that the defendant has refused to honor the terms and conditions of the subject contract of insurance. The plaintiff also claims the defendant is acting in bad faith by withholding payment for the wind damages. The plaintiff further claims it has and will incur substantial costs that it would not have incurred if the defendant had honored the policy.

The defendant is accused of breach of contract regarding the plaintiff’s insurance policy with the defendant, breach of good faith and fair dealing and declaratory relief owed to the plaintiff under the insurance policy.

The plaintiff is seeking an unknown amount in damages, legal fees and exemplary damages.

The case has been assigned to Division F Judge Christopher J. Bruno.
