NEW ORLEANS – After buying a home the purchaser realized a major fault in the home was not disclosed to them by the seller, and has thus filed suit to rescind the sale.
Jouandot Enterprises LLC filed suit against Wells Fargo Bank in the Orleans Parish Civil District Court on June 11.
The suit says the plaintiff purchased a home owned by the defendant that contained Chinese drywall, which must be taken out for the house to be inhabitable. The plaintiff claims it did not know the home contained Chinese drywall and that the defendant failed to disclose this fact.
The defendant is accused of intentionally withholding information about the home that constitutes a redhibitory defect that would have prevented the plaintiff from purchasing the home.
The plaintiff is seeking an unknown amount in damages for the purchase price, all expenses occasioned by the sale, all damages to the plaintiff and attorney’s fees.
