GRETNA – The family of a woman who died when the driver of a car ran off the road and wrecked the vehicle is suing.

Omar Armando Ordonez, Maria Balsamina Enamorado, individually and on behalf of the succession of Karla Adilcia Ordonez, filed suit against Affirmative Insurance Company in the 24th Judicial District Court on June 26.

On Jan. 19, Susan Perez was allegedly drunk and driving her husband’s car with Karla Adilcia Ordonez in the passenger’s seat. The lawsuit alleges that Perez was driving in Metairie when she drove the car off Interstate 10, over the lanes going in the opposite directions and that both she and Ordonez died after they struck a guardrail. At the time of the accident Affirmative Insurance Company allegedly had a policy in place on the vehicle involved in the accident, but they have not made any payments to the survivors of Ordonez, the suit says.

The defendant is accused of breach of contract.

An unspecified amount is sought for damages reasonable under the circumstances and legal interest.

The plaintiffs are represented by attorney Joseph R. Mcmahon III of Metairie.

The case has been assigned to Division C Judge June Berry Darensburg.
