Transportation association files suit against City of New Orleans for allegedly withholding documents

NEW ORLEANS – A limousine association has filed suit against the city for withholding documents involving changes to the city code regarding for-hire transportation services.

Greater New Orleans Limousine Association and Michael D. Brinks Jr. filed suit against The City of New Orleans and The Council of the City of New Orleans in the Orleans Parish Civil District Court on July 18.

The plaintiffs claim they requested access to public documents that they have a constitutional right to view numerous times over a period of three months, but have not received the documents or a written notice explaining a reason for withholding the documents. The plaintiffs say they requested the documetns that would affect their business dealings on April 15. The plaintiffs purport they made numerous other requests for the same documents, or for an explanation why they had not received the documents.

The defendants are accused of failing to comply with Louisiana Revised Statutes 44:32 and denying the plaintiffs their constitutional right to inspect the requested public documents pursuant to Louisiana Revised Statutes 44:31.

The plaintiffs are seeking a writ of mandamus to force the defendants to provide the requested public documents or in alternative to provide them with an adequate explanation for why the documents have been withheld.

Greater New Orleans Limousine Association and Michael Brinks Jr. are represented by Daniel T. Plunkett from the firm of McGlinchey Stafford PLLC in New Orleans.

The case has been assigned to Division I Judge Piper D. Griffin.
