Winn-Dixie sued by customer allegedly injured in fall

GRETNA – A local grocery store is being sued by a woman who claims she was injured in a fall on their premises.

Kim Percle filed suit against Winn-Dixie Montgomery LLC and their insurer in the 24th Judicial District Court on July 21.

On July 28, 2013 Percle claims she was shopping at the Winn-Dixie located at 1070 Westbank Expressway in Westwego when she tripped and fell due to hazardous conditions in the grocery store. The plaintiff alleges she suffered severe injuries in the incident.

The defendant is accused of failing to respond to unsafe conditions on the property, allowing the existence of unsafe conditions on the property, not properly maintaining the property, negligent supervision, failing to warn about deficiencies on the property, failing to warn about hazards on property, failing to provide a safe and adequate means of ingress and egress and not timely correcting or fixing the hazard.

An unspecified amount in damages is sought for mental pain and suffering, physical pain and suffering, medical expenses, inconvenience, loss of enjoyment of life, lost wages, loss of earning capacity and permanent disability.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
