Racetrac sued, accused of negligence after customer’s reported fall

NEW ORLEANS – A woman is suing Racetrac for negligence after allegedly slipping and falling in a Covington convenience store.

Lisa Quigley filed suit against Racetrac Petroleum in the New Orleans Parish Central District Court on July 28.

Quigley claims that on May 26, she was filling her vehicle with gas at the Racetrac located at 601 N. Highway 190 in Covington. The plaintiff alleges that while she allowed her automobile to fill at a pump, she entered the convenience store in order to purchase a soft drink. The suit states that as Quigley moved towards the rear of the store to choose her beverage, she slipped and fell on the floor, which was allegedly wet and slippery.

Quigley claims that Racetrac Petroleum is responsible for the floor and that its condition was unsafe. The plaintiff further claims that she sustained injuries to her knee, back, neck and other parts of her body.

The defendant is accused of negligence, including failure to give warnings of a dangerous condition, failure to keep the common area safe and failure to properly supervise or instruct employees to remedy defects in the premises.

The plaintiff seeks an unknown amount in damages for past and future medical expenses, physical pain and suffering, mental pain and anguish, physical disability, physical disfigurement and scarring, past and future loss of wages, and loss of earning capacity.

The case has been assigned to District D Judge Lloyd J. Medley.
