GRETNA – A waste disposal company is seeing sued after one of its drivers allegedly rammed a dumpster into a pallet of ceramic tiles that fell on top of two men that were standing nearby.

Jimmy Cao and Hong Hanli Le filed suit against Donald Wolff, Foxwolff Waste and Foxwolff Waste LLC in the 24th Judicial District Court on July 22.

Cao and Le contend that on Aug. 23, 2013 they were standing next to a large dumpster being moved by an unknown employee of Foxwolff Waste when it rammed into a pallet carrying ceramic tiles that fell on top of them causing severe injuries and smashing many of the tiles.

The defendant is accused of failing to observe existing conditions, failing to observe the proximity of the plaintiffs to the ceramic tiles, failing to observe due caution, driving recklessly, failing to maintain control of net thrash bin and dropping a large trash bin too close to bystanders.

An unspecified amount in damages is sought for physical pain and discomfort, mental anguish, aggravation, annoyance, disability, pain and suffering, mental anguish, medical expenses, lost wages, loss of enjoyment of life, loss of use of parts of body, impairment of psychological funding, disability from engaging in recreation, property damage and destruction of learning capacity.

Cao and Le contend are represented by Ryan E. Beasley Sr. of the Harvey-based Cao Law Firm.

The case has been assigned to Division F Judge Michael P. Mentz.
