Man claiming injuries in fall off broken bench at Wal-Mart sues

NEW ORLEANS – A man who allegedly had a serious fall after sitting on a bench at Wal-Mart is suing.

Chad Cowart filed suit against Wal-Mart Louisiana LLC in the Orleans Parish Civil District Court on July 23.

Cowart claims that on July 6, that he went outside to sit on a bench at the Wal-Mart Supercenter Store No. 116, located at 4001 Behrman Place in New Orleans, where without warning the bench collapsed, causing Cowart to fall to the pavement resulting in serious bodily injuries. The plaintiff contends that as a result of the incident he has sustained severely painful personal injuries that require ongoing medical treatment.

The defendant is accused of failing to maintain property, warn the general public of a broken bench and creating dangerous conditions.

The plaintiff is seeking an unspecified amount in damages for pain and suffering, mental anguish, medical expenses and permanent disabilities.

The plaintiff is represented by Frank D. Ippolito of The Law Offices of Frank D. Ippolito.

The case has been assigned to Div. N Judge Ethel S. Julien.

Case no. 14-7201.
