GRETNA – A grocery store is being sued by a customer who claims she was severely injured in a slip and fall incident.

Donnea Collins filed suit against Whole Food Company Inc., Whole Foods Market and their insurer in the 24th Judicial District Court.

Collins claims she was a customer in the produce section at the Whole Foods located at 3420 Veterans Blvd. in Metairie when she slipped and fell on a liquid on the floor that had not been cleaned up by the defendant. The plaintiff contends the defendants should have known about the hazard and cleaned the area before the incident occurred. Collins alleges she sustained severe injuries to her bones, muscles, joints, especially to her ankle, foot and leg.

The defendant is accused of failing to maintain the premises, failing to periodically inspect and clean, failing to keep the premises clean, failing to warn of a dangerous condition and failing to place warning signs.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, medical bills, lost wages, loss of medical bills, lost wages, loss of earning capacity and loss of enjoyment of life.

Collins is represented by Allan Berger of Allan Berger & Associates of New Orleans.

The case has been assigned to Division H Judge Glenn B. Ansardi.

Case no. 740-601.
