Malpractice claim filed against Prestige Care

CHALMETTE – Two daughters are hoping to shed new light on their late father’s death by filing a wrongful death lawsuit against his caregiver.

Debbie Mcinnis and Cindy Cooper, individually and on behalf of their deceased father, Archange Emmaus Brown, filed suit against Prestige Care LLC and Ferncrest Manor Living Center in the Orleans Parish Civil District Court on Aug. 1.

The plaintiffs, on behalf of their deceased father, requested a review of medical malpractice against the defendant, Prestige Care, pursuant to state law. The plaintiff allege that Brown died while in the care of Ferncrest Manor Living Center and that they are at fault for his death due to medical malpractice.

State law lays out deadlines for a Medical Review Panel are to be extended for discovery, depositions, motions to compel, production of documents and subpoenas for the purpose of gathering evidence for presentation to a Medical Review Panel.

The plaintiffs are represented by attorney Daniel W. Nodurft.

The case has been assigned to Div. H Pro Tempore Judge Lynn Luker.
