Walgreen's sued by customer who claims injury in trip over stock cart

GRETNA – A pharmacy customer is suing saying she was injured in a fall over a stock cart on its premises.

Mercedes Bittinger filed suit against Walgreen Louisiana Co. Inc. in the 24th Judicial District Court on Aug. 6.

Bittinger claims on Aug., 14, 2013 she was a customer at the Walgreen pharmacy located at 4545 W. Esplanade Ave. in Metairie when she tripped and fell on a stock cart as she attempted to exit the store. The plaintiff alleges she landed on the ground and received significant injuries to her left knee, shoulder, neck and back.

The defendant is accused of failing to provide a safe environment for others, failing to warn customers of the unsafe condition, failing to inspect the premises, failing to detect and correct the unreasonably dangerous condition, failing to take all means and precautions and failing to to reroute pedestrian traffic away from hazardous condition.

An unspecified amount in damages is sought for medical and healthcare expenses, physical pain and suffering, mental anguish, emotional distress, permanent disabilities and loss of life’s pleasures and enjoyment.

Bittinger is represented by Harold L. Ehrenberg of Metairie.

The case has been assigned to Division B Judge Cornelius E. Regan.
