Discount gas station sued by woman claiming disability after tripping over rug

GRETNA – A local discount gas station is being sued by a woman who claims she was disabled in a trip and fall on a rug placed at the entrance of the premises.

Stacey Phillips filed suit against Rick’s Operating Company LLC, Magnolia Discount Store, Magnolia Shell, El-Jaouhari LLC and Maxum Indemnity Company in the 24th Judicial District Court on Aug. 4.

Phillips asserts she was entering the Magnolia Discount Store located at 516 Lapalco Blvd. in Gretna on Sept. 1, 2013 when she tripped on a rug placed at the store’s entrance and fell to the ground. The plaintiff contends she sustained severe and disabling injuries in the incident.

The defendant is accused of failing to inspect and maintain proper upkeep of the premises, failing to warn business invitees of the possible dangers, failing to stake reasonable care and caution and failing to correct a known hazard.

An unspecified amount in damages is sought for physical pain and suffering, emotional distress, medical expenses, loss of earnings, loss of earning capacity and loss of enjoyment of life.

Phillips is represented by Robert J. Caluda of the Metairie-based Caluda Law Firm.

The case has been assigned to Division O Judge Ross P. LaDart.
