NEW ORLEANS – A man is suing for $75,000 after allegedly sustaining a large laceration that required 53 stitches while moving a washing machine at a local business.
Federico Espinoza-Martinez filed suit against World of Taste LLC, Jarosla Rames, Alison L. Spurlin and their insurers in the Orleans Parish Civil District Court on Sept. 8.
Espinoza-Martinez states as of the spring of 2013, Remes employed him to perform maintenance on various residential properties. On June 17, Espinoza-Martinez was scheduled to perform routine repairs at an apartment complex located at 530 Dauphine Street in New Orleans.
The plaintiff insists Rames failed to provide him with the correct equipment or directions to complete this task. As a result, while Espinoza was moving a washing machine, the washer allegedly managed to slip out of his hand, slicing his right palm, ring finger, and pinky finger, leaving an enormous gash.
The defendants are accused of failing to provide proper equipment or aid, scheduling hazardous tasks without proper training, failing to establish safety protocols and failing to provide a secure work environment.
The petitioner is seeking upward of $75,000 in damages for pain and suffering, mental agony, disabilities, medical expenses and loss of enjoyment of life.
The petitioner is represented by attorneys Robert B. Evans III, Cesar R. Burgos, Gabriel O. Mondino and Robert J. Daigre of Burgos & Evans LLC.
The case has been assigned to Div. F Judge Christopher J. Bruno.
