After alleged upskirt video, woman sues Delgado Community College and employee for $50K over invasion of privacy

NEW ORLEANS – A lawsuit has been filed after a man was allegedly caught videotaping under a woman’s skirt at a local community college.

Jennifer Salazar filed suit against Marvin Duque and Delgado Community College Foundation in the Orleans Parish Civil District Court on Aug. 26.

Salazar claims that on Aug. 27, 2013, she was visiting Delgado Community College located at 615 City Park Avenue in New Orleans, when Duque, a Delgado employee, allegedly videotaped under the petitioner’s skirt. Salazar sustained searing personal injuries to her psyche as a result of the incident.

The defendants are accused of secretly videotaping petitioner, disturbing and violating petitioner’s right to privacy, failing to shield petitioner, train its employees given the circumstances, provide its employees proper instruction, supervise its employees, acting perverse given the situation, violating petitioner’s guaranteed right to privacy and failing to protect petitioner against the danger of others.

The plaintiff is seeking upwards of $50,000 in damages for pain and suffering, medical expenses, invasion of privacy, mental anguish, emotional turmoil, public humiliation and embarrassment, degradation, anxiety, hysteria and loss of enjoyment of life.

The plaintiff is represented by Ivan A. Orihuela of Riguer Silva LLC.

The case has been assigned to Div. J Judge Paula A. Brown.
