NEW ORLEANS – A woman walking in downtown New Orleans is claiming injuries after stepping into and falling into wet cement up to her hips.

Kelly Fountain filed suit against Hard Rock Construction LLC, Hard Rock Construction of Louisiana LLC, The City of New Orleans and their insurer in the Orleans Parish Civil District Court on Sept.16.

Fountain claims that on May 16, she was walking down the sidewalk between the intersection of Girod Street and South Peters in New Orleans, where without warning she fell into wet cement, being submerged up to her hips. The plaintiff contends she twisted her leg and sustained acute injuries to her leg, knee, ankle and foot as a consequence of the incident.

The defendants are accused of allowing a hazardous condition to exist, failing to assemble barricades, failing to warn pedestrians of an unsafe condition, failing to look out for the safety of pedestrians and failing provide sufficient safety documents to the hired contractors.

The plaintiff is seeking an unspecified amount in damages for pain and suffering, mental anguish, medical expenses and emotional turmoil.

The petitioner is represented by Patrick H. Hufft of Hufft & Hufft APLC.

The case has been assigned to Div. J Judge Paula A. Brown.
