Woman alleges she was injured by motorized cart at Costco

NEW ORLEANS – A woman allegedly suffered personal injuries after a Costco employee backed into her with a motorized cart.

Jeanne C. Cowart filed suit against Costco Wholesale Corporation in the Orleans Parish Civil District Court on Aug. 27.

Cowart states that on May 15 she was a patron at the Costco Wholesale Store located at 3900 Dublin Street in New Orleans. Cowart proceeded to use a motorized cart provided by the store while shopping, then returning to her vehicle to unload groceries. During this process, an employee came to retrieve the cart, where, without warning, the employee placed the cart in reverse, striking the plaintiff, the suit claims.

The plaintiff contends she sustained acute and debilitating personal injuries that require continual medical treatment as a result of the incident.

The defendant is accused of failing to properly instruct personnel on how to appropriately retrieve motorized carts, allowing a hazardous condition to exist and failing to warn of a dangerous condition.

The petitioner is seeking an unspecified amount in damages for pain and suffering, mental agony, medical expenses and disabilities.

The plaintiff is represented by Frank D. Ippolito of the Law Offices of Frank D. Ippolito.

The case has been assigned to Div. C Judge Sidney H. Cates IV.
