GRETNA – A boat captain is suing his former employer, claiming he was not paid $400 on his last day of work.

Terry Carver filed suit against B&G Towing LLC in the 24th Judicial District Court on Sept. 5.

Carver asserts that he was employed as a boat captain from February 2011 to September 2011 and was paid $400 a day for 12 hours shifts he worked 10 days at a time with 10 days off afterward. The plaintiff claims that on Sept. 7, 2011 he resigned after working one last 12 hour shift, but that B&G Towing LLC failed to pay him for that last day. Carver alleges that by failing to pay him the defendant broke state law, especially when the company failed to do so after he made demand for payment four days afterward on Sept. 11, 2011.

The plaintiff contends he finally received a check on Nov. 10, 2011 that had been sent to his ex-wife’s address. However, Carver asserts the check was only in the amount of $172.65 and he is still owed the balance.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for penalty wages in the amount of 90 days of pay, attorney fees, court costs, expert fees and judicial interest.

Carver is represented by attorney Stephen H. Shapiro of New Orleans.

The case has been assigned to Division I Judge Nancy A. Miller.
