Bellsouth and AT&T allege construction company damaged telecommunications lines

GRETNA – A construction company is being sued by utilities providers for allegedly damaging equipment while digging on a job site.

Bellsouth Telecommunications LLC and AT&T Louisiana filed suit against Roubion Construction Company LLC in the 24th Judicial District Court on Sept. 11.

Bellsouth Telecommunications LLC and AT&T Louisiana assert that Roubion Construction Company LLC was excavating an area of ground for a roadway project when workers damaged underground utilities located at 928 31st in Kenner on Oct. 10, 2013. The plaintiff claims that the defendant did not provide 120 hours  advance notice, as required by state law, before beginning the excavation that resulted in the destruction of property. Bellsouth Telecommunications LLC and AT&T Louisiana allege that the incident resulted in the loss of use of the cables and the interruption of communications.

The defendant is accused of failing to know what should have been known, failing to observe what should have been seen, failing to inform themselves of the location of the utilities, failing to plan the excavation to ensure facilities would not be damaged, failing to maintain safe clearance between the excavating equipment and facilities and excavating without advance notice.

An unspecified amount in damages is sought for property damage.

Bellsouth Telecommunications LLC and AT&T Louisiana are represented by Michael B. Alker of Sutton, Alker & Rather LLC of Mandeville.

The case has been assigned to Division B Judge Cornelius E. Regan.
