GRETNA – A local gas station is suing its property insurer for allegedly not covering losses due to Hurricane Isaac.

Brothers Expressway filed suit against Arch Specialty Insurance Company in the 24th Judicial District Court.

Brothers Expressway, located at 9000 Westbank Expressway in Harvey, asserts it was covered by a commercial property insurance policy issued by Arch Specialty Insurance Company when Hurricane Isaac struck the area on Aug. 29, 2012 and damaged business property, real estate, the gas station canopy and gas pumps. In addition, the plaintiff claims it received further damages from loss of business income and continuing operating expenses.

Brothers Expressway alleges that despite providing sufficient proof of their damages to Arch Specialty Insurance Company the insurer has failed to timely provide any payment for the losses sustained.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for the cost of repairs to the property.

Brothers Expressway is represented by attorney Joseph V. Dirosa Jr. of Metairie.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
