Plumber sues homeowner over alleged injuries in fall

GRETNA – A local homeowner and his insurance company are being sued by a plumber who claims he was severely injured in a fall on its premises.

Raymond Falcon filed suit against Jeffrey Surcouf and State Farm Fire and Casualty Company in the 24th Judicial District Court on Sept. 22.

Falcon alleges that on July 13 that he and his company Continental Plumbing were contracted to provide work at Surcouf’s residence located at 259 East Livingston Place in Metairie. The plaintiff contends that while he was standing on a set of indoor stairs talking to his employees he took a step off the side of the stairway, which did not have safety railings installed, and fell to the floor. Falcon asserts he was injured in the incident.

The defendant is accused of failing to provide a safe environment for his subcontractors, failing to provide an environment free from vices and defects, failing to adequately inspect the construction site, failing to exercise reasonable care, failing to supervise workers who built the staircase, failing to supervise workers who built the staircase and violation of OSHA standards.

An unspecified amount in damages is sought for physical pain and suffering, emotional anguish, distress and expenses for medical care and treatment.

Falcon is represented by Salvador M. Brocato III of the Metairie-based Law Office of Salvador M. Brocato III.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
