GRETNA – A metal fabrication designer is being sued by a homeowner and contractor for allegedly breaching contract on a project by providing faulty work that later had to be removed.
Arch Design Build LLC and Shane J. Guidry filed suit against Caroline Navarette, Caroline Navarette Designs Inc. and an unknown subcontractor in the 24th Judicial District Court on Oct. 7.
Arch Design Build and Guidry contend that on April 3, 2013 they entered into a contract with Caroline Navarette Designs Inc. to design and construct numerous projects including an artistic grand staircase, a rear staircase with metal panels, a garage staircase with a metal railing and panels, an outdoor metal canopy, an interior metal dog door, metal hinges for an exterior door, 10 exterior metal window panels and an exterior metal balcony for a home owner by Guidry located at 201 Northland St. in Metairie.
The plaintiffs assert that during the metal fabrication of the parts the plaintiffs forwarded their concerns surrounding the metal piece designs and found that when they were completed many of the pieces were improperly fabricated and installed ultimately resulting in all work by the defendants being removed from the home. In addition, Arch Design Build and Guidry claim that the defendants damaged other pieces of the property while installing the defective metal pieces. The plaintiff claims that other parts of the order put in to the defendants were never completed and delivered to them.
Arch Design Build and Guidry allege that by the time they found the defendants’ work to be defective they had already made several installment payments for which they later sought a refund, but were allegedly not provided.
The defendant is accused of breach of contract.
Damages in the amount of $195,519.20 as well as 25 percent in attorney’s fees are sought by the plaintiffs.
