Mattress store sues roofing company for $56K after dumpster fire

GRETNA – A mattress store and its property insurer are suing a roofing company after employees allegedly started a dumpster fire next to the store that damaged the building and contents.

Mattress Direct Inc. and Northern Insurance Company of New York filed suit against Progressive Roofing LLC in the 24th Judicial District Court on Oct. 15.

The plaintiffs claim that on Sept. 30, 2013 Progressive Roofing was contracted to construct a new roof on the Jimmy Johns restaurant location next door to Mattress Direct Inc. at 4301 Veterans Blvd. in Metairie. Mattress Direct Inc. and Northern Insurance Company of New York allege that on Oct. 26, 2013 while repairing the roof at Jimmy Johns employees of Progressive Roofing caused a fire to start in dumpster that caused significant damage to the Mattress Direct Inc. store.

The plaintiffs contend that the incident was caused by the defendant’s failure to properly dispose of roofing materials.

The defendant is accused of failing to take action and preventative measures to reduce risk of harm, failing to properly and adequately train employees and conducting its work in a negligent and careless manner.

Damages in the amount of $56,395.10, plus a deductible of $1,000, are sought for repairs to the plaintiff’s business.

Mattress Direct Inc. and Northern Insurance Company of New York are represented by W. Ransom Pipes of Baton Rouge-based Hannah, Colvin & Pipes LLP.

The case has been assigned to Division E Judge John J. Molaison Jr.
