Real estate company, commercial building owner sued by cleaning company for breach of contract

GRETNA – A commercial cleaning service is suing a real estate company and commercial building owner for allegedly wrongfully terminating their contract to clean three local buildings.

Weststar Building Services Inc. filed suit against GBS Properties LLC, Gardner Realtors and their insurer in the 24th Judicial District Court on Nov. 5.

Weststar Building Services Inc. contends that in August 2013 it entered into a contract with GBS Properties LLC and Gardner Realtors to provide commercial cleaning services for buildings located at 3332 North Woodlawn Ave. in Metairie, 4140 Williams Blvd. in Kenner and 1003 E. Judge Perez Drive in Chalmette. The plaintiff asserts that within the contracts the defendants were provided the ability to cancel the contract, with 30 days notice, if they notified the plaintiff of deficiencies that were not corrected within a 15 day period. In addition, Weststar Building Services Inc. claims that failure to follow the contract’s cancellation clause would result in a cancellation fee of 25 percent of the remains gross revenue.

The plaintiff purports to have at all times met the obligations stipulated in the contracts, but that the defendants abruptly canceled the contract without explanation in June 2014.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for 25 percent of the reaming gross revenues left on the contracts.

The case has been assigned to Division O Judge Ross P. LaDart.
