Halloween store sued after man claims he was attacked on premises

GRETNA –  A bystander to a parking lot brawl who was allegedly tackled and beaten by a store employee is suing both the store and his alleged aggressor.

Daniel Parker filed suit against both Robert Marver and the Spirits Halloween Store in the 24th Judicial District Court on Oct. 30.

Parker asserts that on Oct. 30, 2014, he exited the Spirits Halloween store to the parking lot and witnessed a large crowd gathered around two males as they wrestled and pinned a female to the ground. As a Jefferson Parish sheriff's deputy attempted to manage the crowd, the plaintiff claims that Marver attacked, tackled and punched him–resulting in physical damages as well as mental anguish.

The plaintiff claims that both the store and the individual defendant are liable for his personal damages due to their negligence.

An unspecified amount in damages is sought for medical expenses, loss of wages, physical and mental suffering and emotional distress.

Parker is represented by Kevin M. Riley and Michael D. Riley of New Orleans-based Law Office Michael D. Riley & Associates LLC.

The case has been assigned to Division B Judge Cornelius E. Regan.
