Worker allegedly injured after scissor lift falls on him sues

GRETNA – A man who claims he was injured when a scissor lift was turned over on top of him is suing the owner of the premises where the incident occurred.

Pierre Girault filed suit against Scottsdale Insurance Company, Beaux Green Technology LLC, NOLA LED and Blake A. Barrios in the 24th Judicial District Court on Nov. 17.

Girault alleges that he was working in a garage at Peake Automotive where he is employed and where, Barrios,  a subcontractor working for Beaux Green Technology and NOLA LED, was brought in to replace overhead lighting. The plaintiff contends that Barrios relocated a scissor lift he was using in the garage near the garage door and when it was opened it clipped the lift that fell on top of him. Girault asserts he received severe injuries to his leg and ankle in the incident.

The defendant is accused of negligence, failing to warn of the danger and failing to disable the garage door while the lift was located next to it.

An unspecified amount in damages is sought for mental anguish, physical suffering, loss of enjoyment of life, medical expenses, loss of earnings and impaired earning capacity.

Girault is represented by Matthew D. Hemmer of New Orleans-base Morris Bart LLC.

The case has been assigned to Division I Judge Nancy A. Miller.
