Jefferson Parish Sheriff’s Office sued by exterminator over car accident

GRETNA – An exterminator is suing the Jefferson Parish Sheriff’s Office after one of its employees allegedly caused a car accident.

Shelton Dennis filed suit against Sheriff Newell Normand, in his capacity as sheriff/chief law enforcement of the Jefferson Parish Sheriff’s Office, and Michael D. Cummings in the 24th Judicial District Court on Nov. 19.

Dennis asserts that on Dec. 23, 2013, a Jefferson Parish Sheriff’s Office vehicle driven by Cummings failed to yield and made left turn in front of him, striking his vehicle that he used for his exterminating business. The plaintiff contends that the incident was entirely the fault of the defendants.

The driver defendant is accused of failing to yield, failing to see what should have been seen, failing to keep a careful lookout, failing to maintain a safe distance from other vehicles, operating vehicle in careless manner, failing to maintain reasonable and proper control of the vehicle and failing to follow the customary rules of road.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, medical expenses, rental expenses, property damage, loss of use of vehicle, depreciation of vehicle, loss of earnings, loss of enjoyment of life, permanent disability, loss of consortium and attorney’s fees.

Dennis is represented by Jason F. Giles of the New Orleans-based Law Offices of Edward J. Womac Jr. & Associates.

The case has been assigned to Division I Judge Nancy A. Miller.
