Shopping center sued over customer’s injuries allegedly stemming for fall on premises

GRETNA – The owner of a shopping center is being sued by a woman who claims she was injured in a fall.

Ellen Spahr, and husband Paul, filed suit against Fountain Park Center and Robert J. Guidry Investments LLC in the 24th Judicial District Court on Dec. 1.

Spahr claims that on Dec. 2, 2013 she was she was at Parrot Pete’s located within Fountain Park Center at 1901 Manhattan Blvd. in Harvey when she fell due to a hazard on the property. The plaintiff alleges she was injured in the incident.

The defendant is accused of failing to properly maintain the premises, failing to properly inspect the premises, creating a hazard, failing to remedy a hazard and failing to maintain necessary safeguards.

An unspecified amount in damages is sought for pain and suffering, mental anguish, medical expenses, loss of enjoyment of life, loss of household services, disfigurement and disability.

Spahr is represented by Matthew W. Bailey of Baton Rouge-based Walsh & Bailey LLC.

The case has been assigned to Division C Judge June Berry Darensburg.
