After allegedly causing apartment fire couple sued for $22K by property manager

GRETNA – A property management company is suing a couple who allegedly damaged an apartment building by accidentally setting fire to it and as a result breaching the lease on the apartment.

1st Lake Properties Inc., Agents for Sugar Mill West Apartments filed suit against Delesia Potter and Casey Potter in the 24th Judicial District Court on Dec. 4.

The plaintiff contends the defendants breached a lease of an apartment located at the Sugar Mill West Apartments at 4520 Williams Blvd. in Kenner. 1st Lake Properties Inc. asserts it entered into a contract with the Potters who were to lease an apartment from them for $702 a month from Oct. 1, 2013 to Sept. 30, 2014. However, the plaintiff claims that on Dec. 5, 20913 the defendants were cooking food on their stove and did not properly monitor it, resulting in a fire in the premises that damaged the premises.

1st Lake Properties Inc. alleges after the fire the Potters failed to return to the premises to fulfill the terms of the lease and also breached the lease by causing abnormal wear and tear to it in the form of fire and smoke damage.

The defendant is accused of breach of contract.

Damages in the amount of $16,175.10 for damage and $1,993 in lost rents plus costs for eviction and key replacement as well as 25 percent of attorney’s fees.

1st Lake Properties Inc. is represented by attorney Jacob Kansas of Gretna.

The case has been assigned to Division C Judge June Berry Darensburg.
