Homeowner sues for $150K for allegedly defective windows and doors

GRETNA – A local homeowner is suing a contractor company and a window manufacturer for allegedly installing defective windows and doors in his home that had to be replaced.

Michael Motwani filed suit against KC Company Inc. and Pella Corporation in the 24th Judicial District Court on Dec. 22, 2014.

Motwani asserts that he contracted with KC Company Inc. and Pella Corporation to install doors and windows at his home located at 32 Royal Palm Drive in Kenner. The plaintiff claims that following the installation of the windows and doors the glass in both have suffered a failure in the insulation that has resulted in damages to the windows themselves and their wood frames. Motwani alleges that due to the defects in the windows and doors he had to replace them at a cost of $150,000.

The defendant is accused of breach of contract and breach of warranty.

Damages in the amount of $150,000 plus attorney’s fees are sought by the plaintiff.

Motwani is represented by Thomas J. Barbera of New Orleans-based of the Law Offices of Fred L. Herman.

The case has been assigned to Division O Judge Danyelle M. Taylor.
