Woman alleges she tore rotator cuff in sidewalk trip near DoubleTree Hotel

NEW ORLEANS – A woman has filed suit after allegedly tearing her left rotator cuff in a trip and fall on a sidewalk in front of a local DoubleTree by Hilton Hotel.

Jean Hill filed suit against Burris Investment Group Inc., The Phoenix Insurance Company and the City of New Orleans in the Orleans Parish Civil District Court on Jan. 8.

Hill claims on Jan. 8, 2014, she was walking on the sidewalk between Tchoupitoulas Street and Canal Street near the DoubleTree by Hilton Hotel located at 300 Canal Street in New Orleans. Suddenly and without warning, the petitioner claims she slipped and fell on a “1.5 to 2.0 inch drop” directly in front of the DoubleTree by Hilton Hotel doors, incurring severe personal injuries.

The plaintiff contends she sustained cuts and bruises to her face, left arm, both knees, and left toe as a result of the incident. The petitioner further claims she tore her left rotator cuff requiring surgery.

The defendants are accused of failing to warn pedestrians of the defective sidewalk, properly illuminate the sidewalk, replace the sidewalk and admit previous knowledge of the defective sidewalk.

The plaintiff is seeking an unspecified amount in damages for pain and suffering, mental anguish, medical expenses, loss of enjoyment of life and decline in future income.

The petitioner is represented by Robert S. Reich and Michael T. Wawrzycki of Reich, Album & Plunkett LLC.

The case has been assigned to Div. I Judge Piper D. Griffin.
