Wegeaux Cafe sued by woman claiming disability from fall after stepping into open grate

GRETNA – A local cafe is being sued by a woman who claims she was disabled after stepping in a partially open grate in their parking lot and falling to the pavement.

Ella Mae Wiggins filed suit against BMP LLC, Wegeaux Cafe and Underwiter’s at Lloyd’s London in the 24th Judicial District Court on Jan. 30.

Wiggins claims she was a customer at Wegeaux Cafe located at 745 Westbank Expressway in Westwego and was walking in the parking lot when she stepped into a partially open grate and fell to the pavement. The plaintiff alleges she suffered several personal, psychological and emotional injuries in the incident for which she has had to seek medical treatment.

The defendant is accused of failing to maintain the parking lot surface, failing to safeguard the premises, failing to warn business invites of the danger, failing to discover and correct dangerous conditions and failing to inspect the premises for dangerous conditions.

An unspecified amount in damages is sought for physical pain and suffering, discomfort, mental anguish, aggravation, annoyance, disability, mental anguish, medical expenses, lost wages, loss of enjoyment of life, loss of use and function parts of the body, bodily disability, impairment of psychological functioning, disability and destruction of earning capacity.

Wiggins is represented by attorney John B. Noble of New Orleans.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.

Case no. 746-302.
