Homeowners, city sued over drainage problems that allegedly flooded house

GRETNA – A Harahan woman is suing her neighbors and the city government for allowing renovations on the property next to hers that resulted in flooding.

Suzanne K. Scales filed suit against The City of Harahan, Louisiana; Anne Gordon, as surviving heir and legatee of Louise Slayden & John Slayden, and Ronald Gordon & Gail Gordon in the 24th Judicial District Court.

Scales claims the defendants Ronald Gordon and Gail Gordon own a home located at 8437 Huntley Lane in Harahan as part of a succession of  Louise and John Slayden, both of whom are deceased but still listed on property tax rolls as owners of the property. The plaintiff alleges that in 2013, the Gordons renovated the home as they were in the process of removing an old shed and building a new one in its place as well as adding on an additional room to the back of the house.

Scales contends that before the renovation work was undertaken the water drainage in the area worked properly with all rain waters flowing towards a city maintained drainage system. However, the plaintiff asserts that after the work was completed on the neighboring home, including grading to elevate the property and removing a sidewalk that assisted in drainage, water began running into Scales’ yard instead and resulted in severe flooding of her home on Dec. 22, 2013.

Scales claims she contacted the defendants who allegedly denied any responsibility for the flooding. The plaintiff also alleges she has taken the flooding problems up with the City of Harahan.

The defendant is accused of causing property damage, negligence and violation of city ordinances.

An unspecified amount in damages is sought by the plaintiff.

The case has been assigned to Division O Judge Danyelle M. Taylor.
