River Ridge neighbors band together to sue construction firm over alleged property damage

GRETNA – A construction company working on a government road drainage contract is being sued by a group of River Ridge neighbors who claim construction activities on public property adjacent to their homes resulted in significant property damage.

Kristen Baker, Brian Baker, Toni Lobell, Wayne Lobell, Rebecca Herbert, Alan Herbert, Brian Lobell and Janis Stipelcovich filed suit against BLD Services LLC and Thomas Behan in the 24th Judicial District Court on Feb. 25.

The plaintiffs contend they are all property owners of homes in River Ridge located adjacent to a construction project undertaken by BLD Services to improve drainage along Jefferson Highway. According to the lawsuit, the defendant purportedly engaged in moving heavy equipment in the area, pile driving, excavating and employing several pieces of heavy duty construction equipment.

The plaintiffs assert the construction process was negligently designed and undertaken resulting in significant damage to their properties. According the lawsuits, BLD Services inspected the plaintiffs’ property after they complained of the the damages and indicated they would move toward correcting the problems, but never did.

The defendant is accused of violating the Louisiana Unfair Trade Practices Act, failing to meet contract guidelines, failing to perform a review of the work undertaken, failing to prevent damage, failing to use appropriate worksmanship and care and failing to mitigate damages.

An unspecified amount in damages is sought for cost of property damage, diminution in property values, emotional distress, anxiety and personal economic losses.

The plaintiffs are represented by attorney Justin E. Alsterberg of New Orleans.

The case has been assigned to Division F Judge Michael P. Mentz.
