School teacher sues Wal-Mart over slip and fall while shopping for school supplies

GRETNA – A school teacher is suing a local Wal-Mart claiming she was injured in a slip and fall while shopping for school supplies.

Sheila Simmons, and husband Vincent, filed suit against Wal-Mart Louisiana LLC in the 24th Judicial District Court on Feb. 25.

Simmons asserts she was shopping for school supplies at the Wal-Mart located at 8912 Veterans Memorial Blvd. in Metairie when she slipped in a puddle of rainwater that had accumulated on the store's floor and fell. The plaintiff claims she received severe personal injuries in the incident.

The defendant is accused of failing to warn of the hazard, failing to properly maintain the floors, failing to cover the liquid, failing to place warning signs in the area, failing to inspect the hazards, failing to properly maintain the property, failing to properly train and monitor employees, failing to prevent the accumulation of rainwater, failing to protect patrons and failing to have adequate procedures to deal with rain.

An unspecified amount in damages is sought for mental anguish, loss of enjoyment of life, medical bills, loss of income and loss of earning capacity.

Simmons is represented by Craig B. Mitchell of New Orleans-based Mitchell & Associates APLC.

The case has been assigned to Division G Judge E. Adrian Adams.
