Electrical contractor sued by wholesale supplier for $132K for alleged non-payment

Breach of contract

GRETNA – A wholesale company is suing a local electric contractor who allegedly failed to pay more than $130,000 worth of goods used in construction projects.

Wholesale Electric Supply Company of Houston Inc. filed suit against Sun Industries LLC and Todd Berthelot in the 24th Judicial District Court on March 11.

The plaintiff contends it allowed Sun Industries to open an account to provide materials, equipment and supplies which it used on a number of different construction jobs from September 2013 until November 2014. Wholesale Electric Supply Company of Houston Inc. asserts that the open account eventually grew to $132,622.33, which the defendants have not paid.  The plaintiff claims Berthelot is also named in the lawsuit because he gave a personal guarantee on the Sun Industries account.

The defendant is accused of breach of contract and unjust enrichment.

Damages in the amount of $132,622.33 plus attorney’s fees and court costs are sought by the plaintiff.

Wholesale Electric Supply Company of Houston Inc. is represented by Seth Smiley of New Orleans-based Wolfe Law Group LLC.

The case has been assigned to Division F Judge Michael P. Mentz.
