Home elevation company sued for allegedly destroying foundation, making home uninhabitable

GRETNA – A home elevation company is being sued by Gretna homeowners who claim the foundation on their home was completely destroyed during the elevation.

Tuynh Pham and Kim Tran filed suit against Armstrong N Construction LLC and International Insurance Company of Hannover SE in the 24th Judicial District Court on March 14.

Pham and Tran allege that on Aug. 15, 2013 they entered in a contract with Armstrong N Construction to elevate their home located at 1401 Thomas Street in Gretna. The plaintiffs contend that during the elevation the defendant failed to properly secure the home, damaging its foundation.

Pham and Tran assert Armstrong N Construction unsuccessfully attempted to repair the foundation, but only told them it could not be repaired after accepting $21,000 and working on the property for eight months.  The plaintiffs claim the home is uninhabitable due to the defects caused by the defendants

The defendant is accused of property damage.

An unspecified amount in damages is sought for reimbursement for damages, loss of profits, most rent, out of pocket expenses, general damages and attorney’s fees.

Pham and Tran are represented by Leonard K. Fisher III of the New Orleans-based Law Offices of Leonard Fisher LLC.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
