GRETNA – A law firm is being sued for allegedly not appropriately filing suit on behalf of man who claims he was severely injured after swinging a ladder into power line.
Jose Idalgo Felipe filed suit against National Union Fire Insurance Co., George Recile and Chehardy, Sherman, Ellis, Murray, Recile, Griffith, Stakelum and Hayes in the 24th Judicial District Court on March 30.
Felipe claims that on April 20, 2013 he was working at The Delmont Village Shopping Center located at 5151 Plank Road in East Baton Rouge where he was moving a ladder when it struck a live electric wire and he received a shock. The plaintiff alleges after he was severely injured and hired Recile and the Chehardy law firm to represent him in a personal injury lawsuit against Louisiana Energy Gulf State Louisiana LLC. However, Felipe asserts Recile failed to timely file a lawsuit on his behalf allowing over one year to elapse by the time they did file suit and the case to prescribe.
The defendant is accused of legal malpractice, failing to timely file suit on behalf of the plaintiff and deprivation of legal claim.
An unspecified amount in damages is sought for physical pain and suffering, mental anguish, emotional distress, medical expenses, disfigurement, scarring, loss of wages, loss of earning capacity, permanent disability and loss of enjoyment of life.
Felipe is represented by attorney Bobby G. Hawkins of New Orleans.
The case has been assigned to Division B Judge Cornelius E. Regan.
