Alleged pit bull terrier attack on eight-year-old boy leads to lawsuit

GRETNA – The father of a boy who was allegedly injured in a dog attack is suing the dog’s owners and their property insurer.

Robert Fields III, on behalf of his minor son, filed suit against Olita M. Francois, Wilfred Francois, Lyonel Miclis and their insurer in the 24th Judicial District Court on April 6.

Fields claims his eight-year-old son was riding his bike by the Francois house at 1552 Cricket Court in Gretna when their pit bull terrier charged out into street, knocked Fields’ son off his bike and attacked him while he was on the ground. The plaintiff alleges after the dog was pulled off the boy he was taken to Meadowcrest Hospital where he received medical treatment. Fields contends the incident was investigated by by the Jefferson Parish Sheriff’s Office and Jefferson Parish Animal Control.

The defendant is accused of permitting a hazard, creating a hazard, failing to warn of the hazard, failing to take precautions to avoid the incident, failing to remove a dangerous dog from the streets and failing to take precautions such as fencing in the yard to contain the dog.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish and medical expenses.

Fields is represented by attorney Kevin Tucker of Metairie.

The case has been assigned to Division J Judge Stephen C. Grefer.
