GRETNA – A property insurer is being sued by a Marrero homeowner for allegedly not providing the actual cost of damages the home received in a severe storm.

Rita Coleman filed suit against Geovera Specialty Insurance Company in the 24th Judicial District Court.

Coleman asserts she had a property insurance policy on her home located at 2037 Mather Drive in Marrero provided by Geovera Specialty Insurance Company when a hailstorm struck the area on Feb. 24, 2013. The plaintiff claims that in the storm her roof was damaged and water damaged the exterior interior, the home’s contents and other structures.

The plaintiff contends the defendant sent an adjuster to her home who failed to properly evaluate the damage and provided reimbursement far lower than the actual cost of the damages.

The defendant is accused of breach of contract, bad faith claims handling, negligent claims handling, breach of duty, non-prompt payment, negligent misrepresentation and violation of state law.

Damages in excess of $50,000 are sought for loss of property value, repair costs, amount due under the policy, consequential damages, loss of use, litigation costs and attorney’s fees.

Coleman is represented by Tiffany R. Christian of New Orleans-based Binegar Christian.

The case has been assigned to Division C Judge June Berry Darensburg.
