Motorist driving Mercedes sues City of Gretna claiming branch fell on car

GRETNA – The City of Gretna is being sued by the owner of a Mercedes who claims that as she was driving a branch fell off a city owned tree, striking and damaging her car.

Allstate Insurance Company, as subrogee of Melissa Ledet, filed suit against City of Gretna, Jefferson Parish, their insurer and an unknown employee in the 24th Judicial District Court on April 10.

Ledet alleges she was driving her 2013 Mercedes-Benz GL4 on Lapalco Blvd. in Gretna when a large tree branch fell on her vehicle. The plaintiff contends that the tree was located on the road's median and was under the control of the defendants who are thus responsible for the damages. Allstate asserts it paid for the damages to Ledet’s vehicle and that she was required to pay a deductible which should be refunded to her by the defendants.

The defendant is accused of failing to properly warn, failing to adequately and properly maintain the roadway, failing to repair and maintain the roadway, allowing hazardous conditions to exist and failing to exercise due care.

An unspecified amount in damages is sought for property damage and reimbursement.

The plaintiff are represented by attorney Eric H. Veith of Metairie.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
