Boomtown Casino faces lawsuit by patron who claims disability from chair collapse

GRETNA – A local casino is being sued by a customer who claims she received disabling injuries when a chair collapsed on her leg.

Elvira Washington filed suit against Gasset Chair Co., Louisiana-1 Gaming, Boomtown Belle Casino Westbank, Pinnacle Entertainment Inc. of Delaware, Boomtown Belle Casino Westbank and their insurer in the 24th Judicial District Court on April 27.

Washington contends she was at the Boomtown Belle Casino Westbank on May 2, 2014 when a chair manufactured by Gasset Chair Co. collapsed on her leg. The plaintiff asserts she was severely injured and received disabling injuries in the incident.

The defendant is accused of failing to maintain a safe place for visitors, failing to protect safety of visitors, failing to properly maintain the premises, failing to warn visitors of the danger and failing to take steps to avoid the incident.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, medical expenses, loss of earnings, loss of earning capacity, loss of enjoyment of life, permanent disability, loss of consortium and attorney’s fees.

Washington is represented by Matthew Sutton of New Orleans-based Law Offices of Edward J. Womac Jr. & Associates.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
Case no. 749-130.
