Metalworking company sues contractor for alleged non-payment of $200K over a decade

GRETNA – A metalworking company is suing a contractor saying it routinely failed to pay for work completed between 2005 and 2014.

Boes Iron Works Inc. filed suit against Constructionsouth Inc. in the 24th Judicial District Court on May 15.

Boes Iron Works Inc. claims Constructionsouth Inc. subcontracted metalwork on eight construction projects from 2005 to 2014 worth an excess of $2 million. The plaintiff alleges the defendant failed to fully pay for the work completed and still owes $200,000. 

The defendant is accused of breach of contract, failure to promptly pay and misapplication of payments.

Damages in the amount of $200,000 is sought by the plaintiff.

Boes Iron Works Inc. is represented by attorney Keith L. Magness of Gretna.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
