A Louisiana company is suing a Texas business following an alleged contract breach which purportedly forced the plaintiff to duplicate its costs.
Otto Candies of Des Allemands filed a lawsuit June 30 against Ofts of Houston in U.S. District Court Eastern District of Louisiana, alleging breach of contract in a 2014 work agreement.
According to the complaint, the parties entered an oral agreement for crane repair parts and services in the repair of a marine vessel, the M/V Ross Candies, at a shipyard in Port Arthur, Texas. The plaintiff alleges it made a 40 percent down payment to the defendant before the project started, with plans to pay the balance when the work was complete.
The suit says Otto Candies remitted $74,196 to Ofts, which sent repair personnel to the site June 30, 2014. The suit states the workers remained until July 11, 2014, and then left the site with none of the crane repairs performed.
The plaintiff maintains it was forced to hire a third party to execute the work.
Otto Candies seeks damages in excess of $100,000, interest, attorney fees, expenses and court costs. It is represented by attorneys Rufus C. Harris III, Alfred J. Rufty III, Jill Willhoft and Cindy Martin of Harris & Rufty in New Orleans.
