Allegedly faulty installation of HVAC unit at issue in lawsuit

GRETNA – A homeowner is suing an HVAC contractor over the installation of an air conditioning and heating unit in his home.

Rick Cohan filed suit against Adam Stephens, individually and doing business as AS/AC LLC, in the 24th Judicial District Court on June 2.

Cohan asserts that on Jan. 6, 2013 he entered into a contract with Stephens and AS/AC LLC to install a new heating and air conditioning unit at his home. The plaintiff claims that after the installation the defendant had to come to his home numerous times to make repairs, but the issues were never properly fixed. Cohan alleges Stephens and AS/AC LLC eventually installed another unit, which also experienced problems. In addition to not working properly, the plaintiff contends the new unit was also never permitted.

Cohan asserts he received a $300 ticket due to the unit not being permitted and violating parish code, which Stephens allegedly said he would pay for and fix. However, the plaintiff claims the defendant failed to repair the unit, get it permitted and bring it up to code.

The defendant is accused of breach of contract.

Damages in the amount of $3,761 are sought by the plaintiff.

Cohan is represented by attorney Erin A. Fisher of Metairie.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.

Case no. 750-255.
