Contractor, Jefferson Parish sued by homeowner over alleged damage to home from vibrations

GRETNA – A homeowner is suing a contractor for allegedly damaging his home while doing demolition and construction work on his street.

Edward Weidner Jr. filed suit against Hard Rock Construciton LLC, Hard Rock Construction of Louisiana LLC, Jefferson Parish and Gulfstream Property and Fire Insurance Company in the 24th Judicial District Court on June 5.

Weidner alleges he owns a home located at 6908 Glendale Street in Metairie on the street where Hard Rock began construction activities on June 11, 2013. The plaintiff contends the defendants used heavy equipment to break up Glendale Street and also drove heavily loaded trucks down the roadway causing vibrations that resulted in the drywall to crack, the brick veneer and the flooring to become unlevel.

The defendant is accused of inverse condemnation and negligence.

An unspecified amount in damages is sought for property damage, diminution in property value, nuisance, inconvenience, emotional distress, anxiety, economic losses, expenditures for property repairs, lost use of damages, violation of state laws and attorney’s fees.

Weidner is represented by Terrence J. Lestelle of Metairie-based Lestelle & Lestelle APLC.

The case has been assigned to Division E Judge John J. Molaison Jr.
