Man alleges he was laughed at, called a “fraud” after being injured in trip and fall at Danny and Clydes

GRETNA – A man is claiming permanent diability for injuries alleged suffered in a trip over a loaded hand truck.

Samuel Mordica III filed suit against Bottling Group LLC and Danny and Clydes Po-Boys & More LLC in the 24th Judicial District Court on June 22.

Mordica alleges that on March 31 as he was entering the Danny and Clydes located in Harahan he encountered a Pepsi Bottling hand truck full of beverages that was placed in the walkway directly in front of the entrance. The plaintiff contends he was attempting to walk around the hand truck when his leg was caught on one of its wheels and he violently fell to the floor. Mordica asserts that when he screamed and called for someone to call 911 an employee called him a fraud, laughed at him and refused to provide assistance.

The defendant is accused of failing to see what should have been seen, failing to properly inspect the area, failing to maintain the premises, failing to warn of a dangerous condition, failing to use reasonable and prudent care and failing to place a warning sign in the area.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish, permanent disability, medical expenses, loss of income, loss of earning capacity and loss of enjoyment of life.

Mordica is represented by attorney Joseph “Joey”Lahatte III of Metairie.

The case has been assigned to Division K Judge .
