Pedestrian sues motorist accusing who allegedly startled her, causing fall on street

GRETNA – A pedestrian is suing a motorist who allegedly drove into her path causing her to fall into the street and injure herself.

Wanda Johnson filed suit against Melissa Maffei and Go Auto Insurance Co. in the 24th Judicial District Court on June 23.

Johnson contends that on June 23, 2014 she was walking across Veterans Blvd. in Metairie when Maffei, driving a 2103 Toyota Camry covered by an insurance policy provided by Go Auto Insurance Co., turned onto the roadway and nearly ran into her. The plaintiff asserts she was startled by the car and fell into the street. Johnson claims she suffered injuries in the incident.

The defendant is accused of failing to yield, careless operation of a motor vehicle, improper movement, failing to maintain a proper lookout, failing to see what should have been seen, failing to take appropriate action to avoid the accident, inattentiveness, failing to exercise reasonable care and violating applicable laws.

An unspecified amount in damages is sought for pain and suffering, mental anguish, embarrassment, medical care and loss of enjoyment of life.

Johnson is represented by G. Karl Bernard of of New Orleans-based G. Karl Bernard & Associates LLC.

The case has been assigned to Division G Judge E. Adrian Adams.
