Patient blames Healthcare Services Group for injuires from fall

A LaFourche Parish man is suing a Pennsylvania-based health care corporation doing business in Louisiana, alleging premises negligence in a slip and fall injury.

John Mitchell filed a lawsuit Aug. 14 against Healthcare Services Group of Bensalem, Pa., in U.S. District Court Eastern District of Louisiana, alleging negligence in a January facility accident in Thibodaux.

According to the complaint, on Jan. 22, Mitchell was walking near a bathroom at the defendant’s Thibodaux Healthcare Center when he slipped on a foreign substance believed to be water. Consequently, the suit states, he fell on the floor, injuring his shoulder.

According to the suit, the accident was directly and proximately caused by the defendant’s negligence in keeping the facility free of hazardous conditions. Mitchell alleges Healthcare Services failed to post warning signs and/or restrict access to the wet floor area until it was dry and safe for pedestrian traffic.

Mitchell seeks compensation of $625,000, pre- and post-judgment interest, attorney fees, expenses and court costs. He is represented by attorney William R. Mustian III of Stanga & Mustian in Metairie.
