Party City sued by woman who claims she broke her leg, received disabling injuries in slip and fall

GRETNA – A party and accessory store is being sued by a customer who claims she broke her leg after falling on the premises.

Maria L. Thompson, husband and Donald, filed suit against Traveler’s Property Insurance Company of America, Party City of New Orleans #1, Party City of Elmwood and Elmwood South LLC in the 24th Judicial District Court on July 2.

Thompson asserts that on July 19, 2014 she was at the Party City located at 1000 S. Clearview Parkway in Jefferson when she slipped and fell in a puddle of water inside the store. The plaintiff claims the puddle was caused by a leak in the roof that had existed for a long time. Thompson alleges she received severe and disabling injuries in the incident including a broken leg, a blood clot and back pain.

The defendant is accused of allowing an unreasonable risk, having notice of the harm, failing to exercise reasonable care, failing to keep the premises free of hazards, failing to warn of the hazard, failing to provide a safe facility and failing to fix the roof leak.

An unspecified amount in damages is sought for physical pain and suffering, emotional distress, inconvenience and mental anguish.

Thompson is represented by attorney James B. Guest of Kenner.

The case has been assigned to Division J Judge Stephen C. Grefer.
