A Louisiana real estate company is suing the city of New Orleans after the city allegedly sent due process notices to the wrong address.
2222 South Broad filed a civil action lawsuit Aug. 20 in U.S. District Court Eastern District of Louisiana against the city of New Orleans, alleging violation of right to due process notice suggested by the 14th Amendment to the U.S. Constitution.
According to the complaint, the defendant mistakenly provided the plaintiff, which operates several real estate parcels in New Orleans, tax bills to the non-existent address of 2222 South Broad St. in New Orleans, despite the plaintiff's corporate domicile and registered agent being 34177 Elks Road in Slidell.
As a result, the plaintiff never received a due process notice from the defendant and thus the defendant added extra penalties and interest to the original tax bills, the suit states.
2222 South Broad seeks to recover all amounts paid over the amount of the taxes themselves. It is represented by attorney Eric Oliver Person of New Orleans.
